Workplace Investigations
Both California and Federal law require employers to conduct prompt, thorough and neutral investigations into employee claims of wrongdoing in the workplace, including claims of discrimination, harassment, and retaliation, among others. Ms. Bornn has conducted numerous neutral workplace investigations into such matters.
Ms. Bornn is a Founding and Charter member of the Board of Directors of the Association of Workplace Investigators, Inc., (AWI), www.aowi.org. AWI's specific purpose is to promote, improve and enhance workplace investigations in California. Regular members are those who are licensed attorneys, licensed private investigators and/or persons working in-house for an employer and doing investigations exclusively for that employer.
Workplace Investigator Fees $275.00/hour plus expenses.
Testimony concerning Investigation if needed: $350.00 preparation time and $400.00/hour with 3 hour minimum, plus expenses
Expert Witness Testimony
A Human Resources expert may testify at trial concerning the adequacy of a workplace investigation, the appropriateness of disciplinary or remedial action, and other related HR practices and procedures. Nancy Bornn is an experienced employment law attorney who has qualified as an expert witness on workplace issues, as well as on employment law practice standards in malpractice lawsuits.
As an expert witness, Ms. Bornn has testified and evaluated, among other issues, work- place investigations, harassment and discrimination prevention programs, complaint responses, accommodation issues, performance evaluations, disciplinary action decisions, and employee terminations. She is currently (2010) designated and/or has testified as an expert witness in Lenske v. Grey, Los Angeles Superior Court (disability discrimination legal mal-practice issues); Wells v. LAUSD (sexual harassment investigation issues); Catherine Cranford v. City of Huntington Beach (release of medical records issues); Shirley Williams v. Longwood Mgmt. (harassment investigation issues); Edward Macias v. Temple Inland (workplace investigation issues)
Expert Witness Fees: $350/hour for preparation and consultation, $400/hour with 3 hour minimum for testimony, plus expenses.
